'BRIBERY'

Binibintang ng gobernador ng Ilocos Sur, si Luis "Chavit" Singson, si Panggulo Estrada na tinangap ni Panggulo Estrada ng P10 million tuwing buwan, galing sa mga lakan ng jueteng mula Nobiembre 1998 hanggang Agosto 2000. Inaangkin* ni Gobernador Singson na nagdadaan ang pera pangkupkop sa kaniya. The Governer of Ilocos Sur, Luis "Chavit" Singson, alleges that President Estrada received P10 million a month as bribe money from jueteng (illegal numbers game) lords from November 1998 to August 2000. He claims the protection money was channeled through him.

Graft and Corruption
  • Binintang ni G. Singson si G. Estrada na hinihingi niya o tinatangap niya ang pera galing sa tipon ng implementasyon ng buwis na batas sa tabako, Republic Act No. 7171.
  • Mr. Estrada was accused of directly or indirectly requesting or receiving proceeds from the implementation of Republic Act No. 7171, or the tobacco excise tax law, as alleged by Mr. Singson.
  • Mayroon mukhang mali sa lahad ni Estrada ng 'assets' at 'liabilities' na-'file' noong ika-1999.  Sa isang ulat ng Centro ng Investigative Journalism, pinakita na mayroon ugpugan* si G. Estrada at ilan mga kalakal ng 'real estate' via isang corporasyon ng maganak niya.  Ginawa niton corporasyon ng tatlumpung-anim bahay sa Vermont Park, Executive Village, Antipolo City.
  • Inconsistencies in the President's statements of assets and liabilities (SAL) filed in 1999. In a Philippine Center for Investigative Journalism (PCIJ) report, Mr. Estrada was linked to real estate businesses through a family-controlled corporation which constructed 36 townhouses in Vermont Park, Executive Village, Antipolo City.
  • Cinommit ni G. Estrada ng perjurio at mayroon siyang kayamanan na hindi naipaliwanag kasi nakita na mayroon siya, ang asawa niya, ang mga ibang seņora niya, at ang mga anak niya ng mga upgpugan sa ibang kalakal na hindi naulat sa kanyang lahad ng 'assets' at 'liabilities'.
  • Mr. Estrada committed perjury and the offense of unexplained wealth because records show that he, his wife, mistresses and children have other interests in other companies outside of the three firms listed in his 1999 SAL.

'BETRAYAL' NG NIWALANG* MADLA*

Betrayal of Public Trust
  • Binetray ni G. Estrada ng niwalang madla at biniolate niya ang sumpang* panggulong iprotekta ang batas* noong pinigil niya ang pagsiyasat* ng Commisyon ng 'Securities' at Palitan ng isang mukhang escandalo sa stock market.  Inaapektohan ng mga kalakal ang mga presiyo ng mga stock.  Isang nabintang kompaniya, Best World Gaming and Entertainment Corp., ay isang kompaniya ng kaibigan ni G. Estrada, si Dante Tan. Noon Nobiembre 1999, inangking ng chairman ng SEC, si Perfecto Yasay, Jr., na tumawag si G. Estrada limang beses para si G. Tan.
  • Mr. Estrada betrayed public trust and violated his oath of office to uphold the law when he intervened in the Securities and Exchange Commission (SEC) investigation on an alleged stock manipulation scandal involving Best World Gaming and Entertainment Corp., which is owned by his friend Dante Tan. In November 1999, then SEC chairman Perfecto Yasay, Jr. claimed Mr. Estrada called him up five times to intervene for Mr. Tan.
  • Biniolate ni G. Estrada ang pinangakuan* niya noong naging Panggulo siya: "sa aking administrasyon - walang kamag-anak, walang kumpadre, walang kaibigan".  Halimbawa, ipinagtanggol ni G. Estrada ang mga anak niyang lalake: si Jinggoy Estrada, ang alkalde ng San Juan, sa isang nanyari sa ospital ni Cardinal Santos at si Jude Estrada noong ginamit niyang isang aeroplano ng pamahalan papunta sa Cagayan de Oro City na walang permiso.  
  • Mr. Estrada "wantonly" violated his official pronouncement during his inaugural speech "sa aking administrasyon - walang kamag-anak, walang kumpadre, walang kaibigan" (under my administration - there will be no favors for relatives and friends).  Cited as examples were Mr. Estrada's defense of his sons: San Juan mayor Jinggoy Estrada for an incident at the Cardinal Santos Hospital and Jude Estrada for an unauthorized use of a government airplane to Cagayan de Oro City.
  • Ang paghirang ng daan-daang kumpadre at kaibigan sa iba't-ibang puwesto sa pamahalan, pantulong ang panggulo.  Katulad ang pinsang niya, si Cecilia de Castro (na-'involve' siya sa Kagawaran  ng Edukasyon, Kulturo, at mga Palakasang escandalong libro), bayaw, si Raul de Guzman, at pamangkin na lalake, si Roberto de Guzman.
  • Appointment of  "hundreds" of "kumpadre" and "kaibigan" (friends) as presidential assistants and consultants, including cousin Cecilia de Castro (who was involved in a Department of Education, Culture and Sports textbook scandal), brother-in-law Raul de Guzman and nephew Roberto de Guzman.
  • Pinakita rin ng PCIJ ang animnapu't anim na corporasyon na nasa-'board' o mga 'incorporators' si G. Estrada, ang asawa niya, ang mga ibang babae niya, at ang mga anak niya.
  • PCIJ also reported on 66 corporations, with a total authorized capital of P893.4 million, wherein Mr. Estrada, his wife, mistresses and children were listed as incorporators or board members.
  • Binigay ng Philippine Charity Sweepstakes Office na P100 milyon sa Office to the Partnership of the Poor Foundation, isang kapisanan inumpisa ni Dr. Luisa Ejercito, ang asawa ng Panggulo.
  • P100 milion donation given by the Philippine Charity Sweepstakes Office to the Partnership of the Poor Foundation established by First Lady Dr. Luisa Ejercito.

 

ANG MGA VIOLASYON NG CONSTITUSYON

Culpable Violations of the Constitution
Ang mga Magandang Kotse

Inorder ni G. Estrada ang Bureau ng Customs na ibigay ng limampu't dalawang magandang at mahal na kotse para sa mga kasapi ng Cabinet at iba pang tauhan at nang maging bongga sila. Pero, bawal ito alinsunod sa* Customs at Tariff Code.

Luxury Cars

Mr. Estrada's order to the Bureau of Customs to turn over 52 luxury vehicles to Malacanang for distribution to Cabinet members and other senior officials to give them more "prestige," even if it violated provisions of the anti-graft law and Customs and Tariff Code.


Mga Paghirang sa Cabinet


Pinaghirang ni G. Estrada ilang kasapi sa Cabinet, deputies o pantulong sa ibang opisina.  Bawal ito sa Section 13, Article VII ng Constitusyon, kasi hindi puwedeng dalawang paghirang sa isang tao.

 
Multiple appointments of Cabinet officials

He appointed certain members of the Cabinet, deputies or assistants to another office, violating Section 13, Article VII of the Constitution which prohibits dual appointments. 

These include senior deputy executive secretary Ramon Cardenas as director of the Manila Economic and Cultural Office, chairman of the Philippine Coordinating Committee of the Asian Development Bank, chairman of the Philippine Retirement Authority and member of the Movies and Television Review and Classification Board; and Robert Aventajado as secretary for flagship projects, head for the solid waste management commission and chief negotiator for the Abu Sayyaf.
